AG Opinion 7300 of 2017 Regarding FOIA
Township FOIA Coordinators should be aware that the Attorney General recently issued an opinion letter stating that a public body must fulfill a request to produce records using a best efforts estimate that is “reasonably accurate.” Response as to whether a request will be granted, denied, or granted in part and denied in part must be made within 5 days, or 15 days if an extension is invoked. The response must include a reasonably accurate estimate of when the documents will be produced, however, there is no fixed timeline associated with the actual production of the documents, apart from the estimate given by the public body.
